4. The Buyer's personal data may be processed for the following purposes, on the following legal grounds and for the following periods:
- conclusion and performance of a contract for the provision of services by electronic means - article 6(1)(b) GDPR - personal data will be stored for the duration of the performance of the contract for the provision of services by electronic means and thereafter for the period provided for by law,
- conclusion and performance of a sales contract - article 6(1)(b) GDPR - personal data will be stored for the duration of the performance of the sales contract and thereafter for the period provided for by law,
- fulfilment of tax and accounting obligations - article 6(1)(c) GDPR - personal data will be stored for the period necessary to fulfil the tax obligations incumbent on the Data Controller;
- defence, investigation or establishment of claims related to the contract, which is a legitimate interest pursued by the Seller - article 6(1)(f) GDPR - personal data will be processed for the period of claims investigation, up to the maximum period of prescription of claims;
- handling of enquiries made by Buyers with prior to the conclusion of a contract, which is necessary to take action at the request of the data subject before the conclusion of a contract - article 6(1)(b) GDPR - personal data will be processed for the duration of the contact and resolution of the matter;
- for marketing purposes on the basis of - article 6(1)(a) or (f) GDPR - personal data will be processed for the duration of the marketing action or until you withdraw your consent or object to the processing of your data;
5. The recipients of the Buyer's personal data or categories of recipients are:
- tax offices,
- accounting office,
- law firm,
- hosting provider,
- Google Analytics,
- social media: Facebook, LinkedIn, Instagram
- banks,
- payment processors.
6. Every data subject is entitled to:
- the right of access to his/her personal data
- the right to rectification of his/her personal data
- the right to erasure of his/her personal data ("the right to be forgotten")
- the right to have the processing of his or her personal data restricted
- the right to portability of your personal data
- the right to object to the processing of your personal data
- the right to complain to a supervisory authority.
7. If the processing takes place on the basis of:
- Article 6(1)(a) GDPR (the data subject has given his or her consent to the processing of his or her personal data for one or more specific purposes) or
- (b) Article 9(2)(a) GDPR (the data subject has given his or her explicit consent to the processing of special categories of personal data for one or more specified purposes, unless Union or Member State law provides that the data subject may not waive the prohibition referred to in Article 9(1) GDP)
- every data subject has the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.
8. The data subject has the right to object at any time to the processing of personal data concerning them in the following situations:
- against the processing of personal data concerning him/her based on Article 6(1)(e) GDPR [processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller] or Article 6(1)(f) GDPR [processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller]. (f) GDPR [processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child], including profiling under these provisions, for reasons relating to the particular situation of the data subject;
The controller shall no longer be allowed to process such personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or grounds for the establishment, exercise or defence of claims,
- to the processing of personal data concerning him or her for the purposes of direct marketing, including profiling, insofar as the processing is related to such direct marketing,
- against the processing of personal data concerning him/her for scientific or historical research purposes or for statistical purposes under Article 89(1) of the GDPR, on grounds relating to his/her particular situation, unless the processing is necessary for the performance of a task carried out in the public interest.
9. Exercise of rights
In order to exercise the aforementioned rights, the data subject should contact, using the contact details provided, the Data Controller and inform the Data Controller of which right and to what extent the data subject wishes to exercise it.

11. Provision of data
The provision of personal data by the Buyer is a condition for the conclusion of the contract/fulfilment of the order/contact request. In order to conclude a contract/fulfil an order/contact request, a person is obliged to provide such data, and failure to do so will result in the conclusion and fulfilment of the contract or contact being impossible.
12. Security of processing
The controller shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, including but not limited to:
- encryption of personal data;
- the ability to continuously ensure the confidentiality, integrity, availability and resilience of the processing systems and services;
- the ability to rapidly restore the availability of and access to personal data in the event of a physical or technical incident;
- regular testing, measuring and evaluating the effectiveness of technical and organisational measures to ensure the security of processing.
13. Transfer of data
Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction. If you are located outside Poland and choose to provide information to us, please note that we transfer the data, including Personal Data, to Poland and process it there. The Website uses Google Analytics tool provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The Website carries out activities in this respect based on its legitimate interest in creating statistics and analysing them in order to optimise the toponline.co.uk website. The legal basis for the use of Google Analytics is Article 6(1) sentence 1(f) GDPR.

Google Tag Manager
Kividev uses the Google Tag Manager tool from Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). The Google Tag Manager tool is used to manage the tags (markup) of a website via an interface. The use of Google Tag Manager does not involve the storage of cookies or the collection of personal data. The tool allows other tags to operate which, under certain circumstances, may collect data. Kividev uses the Google Ads Remarketing function of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). The legal basis for the processing of your data is Article 6 (1) sentence 1 letter f of the GDPR. Remarketing technology via Google Ads enables Kividev to address users who have already visited the website reports.kividev.com and have become interested in Kividev's offer with targeted advertising on the websites of Google's partner networks. For this purpose, a cookie is created during your visit to the Website, which enables us to recognise you when you visit the websites of the Website's advertising partners. In addition, user behaviour may be analysed, which is then used for targeted product recommendations and the display of interest-based advertising. The data stored in the cookie is not linked with other personal data to create a user profile.
